Music Class Membership Terms & Conditions/Liability Waiver

Terms & Conditions

As a willing participant in classes at Muse Arts LLC, my family, caregivers, and I agree to the following:

Card on File: Muse Arts requires the payment information for each member to be saved on file with our payment processor. Payment information is securely stored with Square.

Refund Policy: Muse Arts does not offer refunds for Membership Tuition once a payment is processed, although credit toward future Membership Tuition may be issued in exceptional circumstances. A fee of $30.00 will be deducted if cancellation occurs prior to the start of your membership.

Class Cancellations: Muse Arts reserves the right to cancel classes due to low enrollment. In such a case, we will make every effort to place you in another class. If we cannot place you in another class, a prorated refund will be given based on the number of days remaining in the month.

Membership Cancellation: Members may request to cancel their membership by contacting Muse Arts in writing. A minimum of 31 days notice is required.

Makeup Class Policy: Members may schedule a makeup class in another age-appropriate Muse Arts class, where space permits. Makeup classes must be scheduled in advance using the Makeup Scheduler, and can be scheduled any time your membership is active. Muse Arts will also provide access to bonus video content as an optional alternative to in-person makeup classes for current members.

Cell Phone/Photo Policy: Our classes are "Cell Phone Free Zones," and as such, we ask that you not take photos or videos during class. Using cell phones in any capacity easily distracts the children (and adults) from the class activities. However, you may take photos before or after class, as well scheduled Picture Days (see calendar). Please inform all caregivers coming to class with your child of this policy.

Food and Drink Policy: We would like to do our best to avoid allergens, messes, and distractions, so we ask that you not bring food or beverage into the space, and be sure to wash hands before class. Having said that, water or milk is permitted in a spill-proof container, and please feel comfortable to nurse your child!

Teacher Absence Policy: Should your teacher be unable to teach due to a planned absence, illness, or emergency, Muse Arts will do everything in their power to provide a substitute teacher. If a substitute teacher is not possible, Muse Arts will either hold the class on Zoom, or cancel the single class as an absolute last resort. If a cancellation does occur, Muse Arts will be in contact regarding class alternatives.

Should the Music Together® con Español teacher be unable to teach, a substitute may conduct the class in English. 

Mask Policy: Masks will be optional for all Muse Arts classes.

Covid Safety Policy: In order to do our best to keep everyone safe and healthy, the following MUST be adhered to:​
  • If you or anyone in your household has tested positive for Covid-19, stay home from class until you are fever-free and your symptoms are generally improving for at least 24-hours.
  • All participants must wear a mask (excluding children under 2 years of age) for at least 5 days in class after you or anyone in your household has tested positive for Covid-19 and has been fever-free with improved symptoms for at least 24-hours.
In the event that New York State or Federal Covid-19 protocols change and no longer allow class to meet in person, our class will be held on Zoom. No refunds or credits will be issued if this occurs.

Dates and Events: It is the responsibility of the parent/guardian to be aware of class dates and holidays. Muse Arts will include all class dates in your Welcome Letter and Welcome Email. You can also access class dates and holiday schedules on the Muse Arts Calendar.

Injuries: Parents, legal guardians of minor students, caregivers, and adult students waive the right to any legal action for any injury sustained at Muse Arts venues resulting from normal class activity or any other activity conducted by families before, during, or after class time.

Privacy: Muse Arts does not sell or give personal information to third parties without express consent. Muse Arts will use your personal contact information for:
  • Delivering session/class information and reminders via phone, text, email, and mail.
  • Promotions that Muse Arts may run from time to time.
  • Promotions that Muse Arts may receive from community and business partners from time to time.
​By enrolling in a Music Together® or Rhythm Kids® class at Muse Arts, a licensed Music Together center, you agree that any information you provide will be shared with Music Together Worldwide. By enrolling in a Canta y Baila Conmigo® class at Muse Arts, a licensed Canta y Baila Conmigo® center, you agree that any information you provide will be shared with Canta y Baila Conmigo® LLC.

Changes to Terms & Conditions: The Terms & Conditions are subject to change at any time, and the most recent version of them will be posted to our website. All registered parties agree to the terms herein, as well as changes to these policies when posted to the website.

Liability Waiver

COVID-19 ASSUMPTION OF THE RISKS AND WAIVER OF LIABILITY
As a willing participant in classes at Muse Arts LLC, my family, caregivers, and I agree to the following:
ASSUMPTION OF THE RISKS: I understand that naturally occurring disease processes (including, but not limited to, the novel coronavirus or COVID-19), may exist in the community, including at Muse Arts, and present an inherent risk that cannot be eliminated. I acknowledge that, although Muse Arts is taking reasonable measures to avoid contact, transmittal, and exposure of disease processes like COVID-19 between people in our classes (including teachers and third parties), it is ultimately my own responsibility to ensure that I take appropriate actions to safeguard myself and my child/children. I understand and agree that as a registered family of Muse Arts, I am accepting and voluntarily assuming the risk that I or my child may be exposed and become ill as a result of COVID-19 and other diseases.
WAIVER OF LIABILITY: I, on behalf of myself, my caregivers, and my child/children, hereby voluntarily release, forever discharge, and covenant not to sue Muse Arts LLC and its owners, managers, contractors, members, employees, agents, and volunteers, or the location owner ("Released Parties") for any claims that may arise out of or relate in any way to my, my caregivers', or my child's/children's exposure to any communicable disease, including but not limited to the novel coronavirus (COVID-19) or any other accident that may cause harm. I also assume the inherent risk of being outdoors with my child/children including but not limited to ticks, bees/yellowjackets, insects, poison ivy, or other outdoor hazards. The claims hereby released include, but are not limited to, claims of negligence against any of the Released Parties.
 

 
It is your responsibility to ensure that any adult who brings your child/children to class has read and understood the Terms & Conditions and Liability Waiver prior to attending the class.
